These Terms of Service ("Terms") govern your access to and use of the website at buildska.com (the "Site"), operated by Buildska LLC ("Buildska," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Use of the Site

The Site is provided for general informational purposes only. You may access and view the Site for your personal, non-commercial use, subject to these Terms. You agree not to:

No service relationship

Browsing the Site or submitting an inquiry through the contact form does not, by itself, create any consulting, engineering, contractor, or other professional relationship between you and Buildska LLC. Any engagement for services will be governed by a separate written agreement executed by both parties. For clarity, any actual client engagement for contract, data engineering, or IT services will be governed by such a separate written agreement, and nothing in these Terms limits, modifies, or supersedes the terms of any such separate agreement.

Intellectual property

All content on the Site, including text, graphics, logos, code, design, and the "Buildska" name and mark, is owned by Buildska LLC or its licensors and is protected by United States and international intellectual-property laws. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Site without our prior written permission, except for normal browsing and personal, non-commercial viewing.

Submissions

If you submit information through the contact form or otherwise communicate with us, you represent that the information is accurate, that you have the right to share it, and that doing so does not violate any law or third-party right. Information you submit is handled in accordance with our Privacy Policy.

Third-party links

The Site may contain links to third-party websites that we do not own or control. We are not responsible for the content, policies, or practices of any third-party sites, and providing a link does not imply endorsement.

Limitation of liability

To the maximum extent permitted by applicable law, in no event will Buildska LLC or its officers, members, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your access to or use of the Site, whether based on warranty, contract, tort, or any other legal theory, and whether or not Buildska LLC has been advised of the possibility of such damages. Buildska LLC's total aggregate liability in connection with the Site will not exceed one hundred U.S. dollars (USD $100). This aggregate cap applies only to your use of the Site and does not apply to, limit, or supersede any liability provisions in separately executed client service agreements.

You agree to indemnify and hold harmless Buildska LLC and its officers, members, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site or your violation of these Terms.

Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Sacramento County, California, and you consent to the personal jurisdiction of those courts.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Effective" date above. Your continued use of the Site after any change indicates your acceptance of the updated Terms.
